New-build questions

  • Buying off-plan means purchasing a property before — or while — it is being built, based on the developer's plans, specifications and show units. You reserve early, pay in stages as construction advances, and complete once the home is finished and has its licence of first occupation. Buying early often secures the best prices and the widest choice of units and finishes.

  • New builds in Spain are protected by law: a ten-year insurance policy covering structural defects, a three-year warranty on installations (plumbing, electrics, etc.) and a one-year warranty on finishes. While the property is under construction, any deposits and stage payments you make must be protected by a bank guarantee or insurance policy, so your money is safeguarded if the developer fails to deliver.

  • Payments are staged. You typically pay a reservation fee to take the unit off the market, then around 20–40% of the price (plus VAT) across the build through the private purchase contract, each instalment backed by a bank guarantee. The remaining balance is paid at completion before the notary, when you receive the keys. Your lawyer checks every guarantee and milestone before you transfer funds.

  • Unlike resale homes (which pay transfer tax / ITP), new-build purchases pay 10% VAT (IVA) on the price, plus 1.2% AJD (stamp duty) in Andalucía. You should also budget for notary, land-registry and legal fees — usually adding up to around 12–13% on top of the purchase price. I'll always give you a clear cost breakdown before you commit.
